AOS Based on DV2010

  • AOS Based on DV2010

    Hello everybody! Please share your experience and knowledge.

    I will apply for AOS based on DV2010 Lottery.

    My number becomes current in May as the bulletin shows.

    Here are my questions:
    1. When do I send my application? Can I send it now or I have to wait until May 1st?

    2. Since I am applying because I won the lottery do I have to submit any sponsor or financial documentation?
    Its is said in the instruction that if AOS is based on employment you have to submit your employer's docs and sponsorship...or your affidavit of support if your AOS is based on marriage or relative sponsor...But there is nothing about DV Lottery...

    Advise. please.

      I did, I filled total 4 forms: I-485, I-765, I-131, G-325a

        I'm in the same boat. I'm doing AoS based on DV-2010.
        You cannot send your forms right now. Just wait and send them in the end of April.
        And could you please tell me what documents you going to send to USCIS? If you miss anything I'll tell you what also you need to attache.
        And what about SPONSOR or FINACIAL documents you might not need them. It depend how long you have been here in US.

          Well I have been here for almost 2,5 years as an F1 student.
          I have checked the USCIS web site and here is what they say is required to be submitted:

          1.Two passport-style photos
          2.Form G-325A, Biographic Information, if you are between 14 and 79 years of age
          3.Copy of government-issued photo identification
          4.Copy of birth certificate
          5.Copy of passport page with nonimmigrant visa (if applicable)
          6.Copy of passport page with admission (entry) stamp (if applicable)
          7.Form I-94, Arrival/ Departure Record (if applicable)
          8.Form I-693, Report of Medical Examination and Vaccination Record
          9.Applicable fees
          10.Copy of the approval notice for Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant Form I-797)
          11.Certified copies of court records (if you have ever been arrested)
          12.Copy of the principal applicant’s selection letter for the diversity visa lottery from DOS
          13.Copy of the receipt for the processing fee of the diversity visa lottery from DOS
          14.Principal applicants must also submit evidence of a high school diploma or its equivalent, or evidence of 2 years of work experience in an occupation requiring at least 2 years of training or experience in the past 5 years.

          Work & Travel Authorization
          Generally, when you have a pending Form I-485, it is possible for you to apply for authorization to work in the United States and to seek advance parole (advance permission to travel and be admitted to the United States upon your return). For further information, see the “Work Authorization” and “Travel Documents” links to the left under “Green Card Processes & Procedures.”


          I have all these documents ready except #10, but I do not understand what that is and I am not sure if I should file Work&Travel Forms...and do I still need to submit anything about the finances or my I-20 forms from school are enough?

            Did your number become current?
            You know I just called uscis and they told me that there is a 90 days advanced period when you can apply before the time your number becomes current...but I do not know if I should do it...

              Its up to you, file them or not, but I did.

                  Oh ok, now i see. Did you submit form I-485? Are you sure that you don't want to submit form I-765?

                      Yes I sent them but mine looked a little bit different and I received it back only with a simple stamp "PAID March 24 2010" on it and that's it...
                      Is that OK?

                          Yes, it's ok. So, you also need to send them that form(I sent them original).

                            Yes sure, thanks . That is the receipt as I understood.
                            And what do you think about the financial or support thing? Do I need it?
                            By the way when did you send your documents? And how long did it take to get the invitation for the fingerprints after you send them your documents?

                              I recommend you to file I-765. Right now it's free, it doesn't cost anything. But if you would like to apply for Work Permit soon after you receive your Green Card, you will pay $340 for that form. Again, it's up to you.
                              Send them all documents in the meddle of April, i think it will be ok. Coz I know one guy, his case number wasn't current and he sent all his docs to USCIS, and you know what? USCIS sent docs back to him.
                              In your case i think middle of April would be ok.
                              Don't worry about work&travel documents
