  • 250% income from October 15?

Hi good evening to all. I have been reading a bunch of articles about the new public charge rule modifications. And one article mentioned that for i864, the income requirement will be 250 percent of poverty level instead of 125 percent. I was not able to find the exact line on USCIS website. Can anyone please let me know if I'm right ?

It is more complicated than that. On October 15th the sponsors income will no longer be sufficient to overcome the "public charge" bar. It will be one of many positive and negative factors that the io/co must consider when making a determination of the likelihood of the prospective immigrant becoming a public charge. If the prospective immigrant has more positive factors than negative factors then 125% FPL is sufficient. If the immigrant has more negatives than positives then a 250% FPL income will be needed for i-864.

Are these ‘positive’ and ‘negative’ factors spelled out somewhere?

Hoping these aren’t arbitrary BS factors.

Please see below URL. It is a study done by Kaiser family foundation. Go to the bottom right above Endnotes and you will see all the heavily weighted positive and negative factors. Just remember that if you have already filed, you may be on the "old" rule which is 1999 guidance and this MAY not apply to you. I do not know for sure and am just giving you my opinion based on what I have read.

I have seen your post and I was wondering if you could give me a little bit of hope.
My husband and sponsor made a mistake filling the I-864 in the "Current Annual Income", he reported more because that wasn't clear for him... (He got a new job last June)
Do you know what we should do to correct the mistake? Should we just wait to get an RFE?

Thank you so so much if you can answer this question!!!!
