    Hi All,

    I recently did concurrent filing for AOS via marriage to USA citizen early July 2019. I complete my bio-metrics late July 2019 also. i am waiting for my EAD. I am currently working using EAD from pending asylum - This EAD has not been renewed yet and it is due to expire first week of Sept 2019. I am also currently employed and i do not want to loose my employment cos i am the only one work working at the moment, my spouse isn't. I need help and advice on what to do to get my EAD.

    You could try expediting it showing financial hardship. Still will take a few months at least, unfortunately.
    2018 Marriage-based AOS (I-130, I-485, I-765)
    07-09: Package Delivered to USCIS Chicago Lockbox
    07-17: NOA texts & emails (~10:30 pm)
    07-17: Checks cashed
    07-20: 3 NOAs received in the mail
    07-27: Biometrics letter in mail; scheduled for 08-08
    07-30: Biometrics done; USCIS received on 07-31
    08-02: RFIE for proof of legal employment; replied 08-04
    08-08: USCIS received RFIE, case no longer on hold
    10-04: AP approved
    11-28: Case Ready to Be Scheduled for Interview
    11-29: EAD approved

      I would say it is very unlikely for you to get the AOS EAD before your previous EAD expires. It's probably a good idea to apply to renew your pending asylee (C08) EAD. If you file the renewal before the EAD expires, your employment authorization would be automatically extended for 180 days, allowing you to continue working without interruption. The downside to filing for renewal is that it costs $410, but if it allows you to work that is probably worth it.

        If i renew my pending asylee EAD i get 180 days automatically even if the EAD card has not be mailed to me?And is there a way to proof this to my employers?

          Yes, as long as you have gotten the I-765 receipt for the renewal. The I-765 receipt will point this out, and you can show this USCIS page, this fact sheet, as well as this section of the Handbook for Employers.

            One more question. I heard you can only have one application at a time. Renewing my asylee EAD wont hurt my chances of getting the EAD via AOS?

              I am not sure if there is any truth to that, but even if it does affect your AOS EAD, that's still better than not being able to work for several months.
