  • August 2019 filing

    Hey all,

    I see the hurdles everyone has gone through and is going through every year to find a stand in the USA and I am one among those millions.

    So, here is my story,

    August 2013: came to USA on F1 visa
    August 2018: F1 visa expired
    May 2019: I20 expired
    August 2019: registered for fall 2019
    August 2019: got married to an US citizen
    upcoming events: September 2019: willing to file I-485 and I 130

    my worry/question is to find out if I am eligible to apply for adjustment of status inspite of being out of status since May 2019?

    My husband lives in the bay area, CA and I will be filing my paperwork from CA.

    Any advice/tips are very much appreciated.

    Yes overstaying is usually forgiven when doing aos
    Marriage AOS (from tourist visa)
    Received Nov 4th& Priority Date also Nov 4th
    I130 i485 & work permit (did not apply for travel documents )

    Nov 15 received 2 hard copies for NOA
    Nov 22 Received biometrics appointment Notice
    Biometrics done, Dec 2nd.

    Jan 6 2020 courtesy letter for missing medical (dated Dec 31 2019, mailed Jan 2nd 2020)
    Ready to be scheduled for interview (Jan 31st 2020)

      Thank you very much for the reply islanggirl93. I am wondering if it is necessary that i go through an attorney or just do it by ourselves or using services like simple citizen or someone else.

        If that is your only "issue" (overstay for a couple of months) and you are willing to read a lot to understand what you need, you can save a lot of money by doing it yourself. There is a lot of information so anyone with a "simple" case can do it.

          Just like you I was out of status for a few months when I filed mine too, you don’t necessarily need a lawyer, If you’re being petitioned by your US citizen spouse. But like Enub4 said, you’ll need to do lots of research and follow instructions for the required forms. All the best!

          02/16/19 Sent priority mail to USCIS (I-485 & I-765)
          02/22/19 Got delivered to USCIS
          02/26/19 credit card charged and got 2 NoA texts
          03/02/19 NOA mail received
          03/09/19Biometrics appointment notice for March 20
          03/14/19 rfie response sent
          03/15/19 USCIS receives rfie response
          03/25/19 I-693 courtesy letter
          05/14/19 Ready to be scheduled for an interview
          08/31/19 ead card delivered
          11/04/19 I-485 interview scheduled

            Thank you for the reply love21. Atleast now, I am not as worried. I understand its a pain stakingly long procedure. I will start working on the required documents required on my behalf and on my spouse's behalf.

              thank you Enub4, over stay is the major issue in my case, yes. So, I will talk to my husband and see if we can do this ourselves. Like you said, we can save a lot money though we might go through online immigration services its just that we couldnot decide between simplecitizen or ********* immigration.

                travellingbeauty I will recommend you to use RapidVisa.. they are very good at it, I used them for my K1 (Fiance) visa and I also use them for my adjustment of status, everything was perfect.. if you try to do it yourself, you might be getting several RFE from USCIS which may prolong your case.. Good luck

                    HJens thank you for the advice. Actually I was going to pay for ********* immigration today and start my AOS papern work started but now, I will also research about rapidvisa and continue with the best option.

                              If you do not mind asking me, what is your filed office? I applied in August of 2019 as well.

                              My status now says "ready to schedule for interview" since March 16.

                              09/14/19 Biometric schedule for 09/24/19. Mississippi office
