Difference between Final Action Dates and Dates for filling for EB2 catagory

Hi every one,

My labor was approved last week and my priority date is Jan2 2019. I am from Pakistan. My attorney is saying that I can not file concurrently as my PD is not current. In Visa Bulletin Sept 2019 it says that I can file "The “C” listing indicates that the category is current, and that applications may be filed regardless of the applicant’s priority date". Please advice. I want to make sure before I reply to the attorney. I would be thankful if some one reply me as soon as possible.

For whether AOS (I-485) can be filed, you must look at USCIS's chart. For both August and September, your priority cannot file for EB2.

The good news is that you will be able to file as soon as the new fiscal year starts in October 2019 (most likely).

You will know for sure around September 16. You just need to visit the site newacct posted above.
