  • RFE in L1A visa Extension

    Hi,
    Could someone please assist me. Have few questions regarding Green Card.
    My GC was filled under EB1 category, I'm done with my GC interview, and its been more than 180 days since my I-485 has been filled. I have a valid EAD/AP which is valid until May-20.My L1A visa expires on Dec-19., so my company filled L1A visa extension , which now got an RFE. Question I have is
    (1) Will my L1A extension RFE impact green card, even If I have valid EAD/AP
    (2) Can I withdraw my L1 extension or what if its rejected again when i re-submit my RFE
    (3) In such an instance, can I change jobs based on my EAD/AP.

    1.- L1A process is not related to GC process (from what I read), so don't worry about the RFE
    2.- Don't know much about L1A but I think you can withdraw or they can deny the extension, you will use EAD to keep working after Dec-19
    3.- Yes, I think that with EAD you can change jobs if you want or continue working for the same company. Edit: see comment from scientist2016 below

    BTW, you can renew your EAD up to 180 days before it expires. We are planning to send the documents around 120 days before expiration if we don't get the interview/GC before that.

    When was your GC interview? Can you get your GC starting the next fiscal year (Oct-2019)?

      If by changing jobs you mean leaving the current organization, I would recommend against it, since the petition is for your role as a manager with the current organization. So, changing organizations would lead to future complications (e.g., RFE before the actual GC issuance or questions & denial at the time of naturalization 5 yrs. down the line, etc.)

        Scientist2016: Yes my changing jobs I meant changing organization.

        Enub4: My GC interview was in Feb-2019. Yes on paper I have chances of getting it before year end as well, but way things are it keeps changing every time

          I think for employment based GC, it’s better to stay in your current job until the GC is approved and issued. Moving to a different company/ job would pose complications - you may also have to restart you application and find another company that would sponsor your EB1.

          My first GC application was also EB1. I wanted to move to a different city and a different role in the company but I was advised that this will impact my GC application. I ended up canceling my EB1 and re-applied for a marriage based GC instead.
