  • i130 & i485Processing time

    Im from Mexico and been married for 4 years with an american citizen.
    On 2016 we filled the i130 and i485 and pay the fees for this process. Months later we decided to come to live to mexico until i get my greencard and work permit.
    This has take too much time, just two months ago she flew to Georgia where we lived and immigration asked my wife a lot of documents (our kids birth certificates, photos, proof that im living in mexico, etc)

    one month ago i get this email:


    USCIS has approved your I-130 petition and it has been submitted to the Department of State National Visa Center (NVC) for further processing of your pending Visa.

    Does anyone knows what we can expect? Whats the next steep? and any estimate of time to complete all the process?
    I think its too much 3 years just to get the i130 approved.

    If I am reading this right, you left the US after you applied for the I-485 Adjustment of Status?

    You can not apply for Adjustment of Status (I-485) if you are not living in the US. If you applied for I-485 and then left the country without an advanced parole card, they will view your application as abandoned. Which means they are not working on your Adjustment of Status at all. Since you are not living in the US you would need to apply with different kind of paperwork.

    The I-130 doesn't really have anything to do with applying for the green card or work permit. What kind of paperwork did you submit for the work permit? Have you filed other paperwork other than the I-485 for the green card? Having an approved I-130 does open the door to these things and is a really good sign because they have accepted your marriage to your US spouse as genuine.

      Do you have the I-130 approval?
      Did you instruct USCIS that you will do consular processing in Ciudad Juarez, México?
