  • I 130, I 485 and then advance parole

    Hello all:

I am married to a Green Card holder. I have a legal status (student with valid I 20, but I cannot leave the country as my visa is expired) and I am applying for I 130, I 1485 and advance parole this week.

I hope you can expedite your AP. Good luck.

The fastest is, once you have a receipt number for your I-485 (on the paper receipt or on an SMS/email notification), go in to a USCIS office to request Emergency AP. However, Emergency AP is only for very urgent situations like a family member is dying or has died, and I am not sure if your situation rises to that level of severity. If that doesn't work, you can request that your AP be expedited over the phone.

This is my personal opinion and is not to be construed as legal advice.
