  • Does my wife need to bring her son's birth certificate?

    My wife will have her AOS interview soon. The I797C - Notice of Auction says: "If you have children, bring a birth certificate for each of your children".
    Can someone please clarify if the line above is applicable only for the beneficiary who is bringing the child(ren)? Please note her son is over 21 and he not immigrating to the US.
    Will USCIS accept a scanned and translated copy of her son's birth certificate?

    My wife's timeline:
    03/04/19 - Forms 485,130 and 765 received by USCIS
    04/04/19 - Biometric
    07/16/19 - RFE issued by USCIS (asked for the 2018 Taxes)
    08/13/19 - Evidences received by USCIS
    08/26/19 - Interview was scheduled
    10/01/19 - Interview
    10/02/19 - New card is being produced.
    10/07/19 - I-797 received informing the I-130 and I-485 have been approved.
    10/07/19 - Card was mailed to my wife
    10/10/19 - Card received (7 months and 7 days but her card states "resident since 10/2")

    My wifes kids are in their 30s (we are older) and we still had to provide them. do not read into questions. If they ask for it and it applies, provide it. Better to not need it than to have your green card process held up over ir.

    9-26-18 I-765 and I-131 Approved
    10-02-18 Card Was Delivered To Me By The Post Office (sent to Lawyer) Day 167
    10-03-18 Case is Ready to Be Scheduled for An Interview Day 168
    10-05-18 your case has been scheduled for a interview. Day 170
    11-13-18 Interview
    11-13-18 New card being produced
    11-15-18 I130 and I485 Approved
    11-20-18 Card Mailed

      Thanks for your comment. If I knew about it earlier, I'd ask him to send it to us. Now I need to expedite this birth certificate asap.
