  • Will additional information for i485 delay EAD card?

    So I filed everything with my lawyer 05/02/2019
    just recieved a notification that for my i-485 I need a long version birth certificate not short.31/09/2019
    Its about 2 business weeks out. Could my EAD card be produced in that time? or is it all on hold until they get that information.
    I feel like I have been waiting a year for this thing.
    Filing was in California office.
    my lawyer never told me anything about a long birth certificate and thats all she does.
    any info would be awesome, tired of getting my hopes up I saw that immigration letter in mail thought it was notice for EAD card being produced so was quite disappointing.

    I asked this question to a USCIS officer when I got my RFE and she said all cases linked with the I-485 would be put on hold. After I sent my RFE and they received it, it still took them about 1 week to start working on the case again.... it is indeed very disappointing... I was hoping to have received my EAD by now.

      In my case, no.
      It took me a month from the notice of RFIE to them receiving my respond, but I received the EAD 5 and 1/2 months after submission.

        Thank you for your responses, I did send my short birth certificate, but from what theyve said they need full version with parents names on it. Which is fine im getting an emergency one sent. itd be nice if this doesnt hold it up. my lawyer said some people filing from California are recieving their EAD card in 4 - 5 months so im just past 4 month mark now, I hope this happens soon.

          I had an RFE for a typed version of my birth certificate since they did not like the hand written original that was with my application. At the same time I was waiting to hear about an expedite for my EAD but everything was put on hold until they received my new birth certificate. I sent the new one within 5 days of the the notice but it took them nearly three months to acknowledge the fact they they received the evidence. Everything was on hold for that time. I had to put in a new expedite request and it was assigned to an officer after I sent them proof of financial loss it has been nearly a month since I sent the proof. I wish you luck and hope your case moves faster than mine!!!

            I dont understand it, my wife got her permanent residence card work visa within 3 months in Canada, could come and go between getting it as she pleased. Yet the US government expects you to live not have any income or be able to go visit family for 6+ months, a country you need medical insurance in ect. Im wondering what evidence I would need to expedite my case, I cant wait another 3 to 4 months.

              I know, right?? Extremely frustrating.
              But from what I understand you need to be able to prove extreme hardship in order to expedite.... for example death or imminent death to close family member. Or maybe urgent medical assistance from home country?
