    Hi All,

    I received notification that my Interview has been scheduled, our lawyer has contacted me telling me that i need to obtain a new medical because my original medical is only valid for 1 year, presumably thinking that this is due to it being signed before the change of rules on 1st November.

    Details as follows:

    Original Medical obtained and signed on the 28th September 2018
    !-140 submitted for premium processing on the 5th of November 2018
    I 140 was approved and I485 was sent in on the 19th of November, so we can safely assume it was received within 4 days from this date and therefore within 60 days from signature.
    Interview expected to be at the start of October, i.e over 12 months from original Medical signature.

    My reading of the USCIS website is that my i-685 is valid for 2 years because it was submitted to the USCIS within 60 days of signature?

    A. Results of the Medical ExaminationThe physician must annotate the results of the examination on the following forms:Panel Physicians



    Can anybody confirm my position?

    1.- Your form was submitted after November 1, 2018
    2.- Your form was signed no more than 60 days before underlying benefit application filed with USCIS
    3.- Your I-485 was filed no more than 60 days after civil surgeon signed the I-693

    Your I-693 is valid for 2 years. It will expire by the end of September 27th, 2020.

    If you read both tables from your link (medical submitted before November 1, 2018 and after November 1, 2018), your form is valid for 2 years in both.

    Nov 2018 - Package sent - EB - Texas Service Center
    Day 1 - Package received at the lockbox
    Day 999 - Card delivered to me - Aug 2021

      Your position is correct, and your I-693 should be valid for 2 years.

        Thanks for the input all.

        I received my interview letter today and it states that my application “Received Date” is 5th of December. Is this the same as my date of filing? If so, I’m outside of my 60 day window and my interview is 6 days after the 1 year date of my Medical’s so I then have to redo?

          If your I-485 (with I-693) was sent 19th of November, it seems strange that they received it until 5th of December.

          What is the date in your I-485 NOA? mine reports the date that FedEx delivered the package.

          Anyway, it also looks strange that if they, in fact, received the package on the 5th of December and your I-693 was signed on 28th of September. Because the I-485 (and I-693) were submitted after November 1, 2018, then your I-693 is not valid at all.

          Did you receive an RFE for new medical? if you didn't, then they know your medical exam is still valid. They can send an RFE after your interview in the rare case that the officer hasn't looked thoroughly and missed the validity of your medical.

          My guess is that your application arrived before the 60 days and your medical is valid for 2 years.
