    Hello,

    I submitted the adjustment of status for my wife in July. We just received a request for initial evidence stating that I need to provide another sponsor - one that has tax returns.

    Background: At the time of submitting, I had just gotten hired and had not received a paycheck yet. Now, I have received 4 paychecks and make well over the poverty line for a household of 2. I wrote a letter with my I-864 package stating that I don't have taxes because I've either been unemployed or made below tax limit. I also provided my offer letter stating my salary.

    Question: can I send copies of my 4 pay slips to show how much I make or do I have to find another sponsor completely? Wouldn't it be more important that I make enough to take care of my wife? Not find someone to take care of her...

    Can you show previous years of Tax Returns? Would these previous years Tax Returns prove that you are capable of earning more than the poverty threshold for a household of 2 persons? I'm thinking Tax Returns are only one way to prove financial capability. Do you have stocks or bonds? Time Deposits? Property? If you do, these may convey financial capacity to support your spouse. Employment is only one way to prove financial capacity.

      I think that if you don't respond with the information they are requesting, your process could be denied.
      You can try sending a letter, copies of your pay slips, letter from the company but in the end they can deny the application and you will need to start again.

        Not true. The I-864 does not require you to have filed a tax return if you weren't required to file a tax return in the last 3 years. The instructions say to check the box saying you weren't required to file, and attach a statement.

          I cannot, unfortunately. I have not filed taxes because I've either been unemployed or made below the amount to file taxes. Nothing else besides money in my account and a very well paying job. I guess I'll have to get a cosponsor.

            Yeah, I figure I'll just get a cosponsor. I don't wanna risk sending pay slips.
