Urgent questions for I-485 marriage-based green card interview

  • Urgent questions for I-485 marriage-based green card interview

    I will have my marriage based green card interview soon. Anyone who had similar situation or who know about this please help!
    My location is WA. I have a few questions:

    1.For the i693, I submitted during my application but it was one more year ago (May 2018). I heard that before Nov. 2018, the validity of the test was just one year, do I need to redo the test and bring a proof from doctor during the interview?

    2. When we submitted the application my spouse was not working and I was working as H1B. So he was my sponsor but his income came from his spouse (me). That was what the lawyer wrote. But now I have been unemployed for several months. (will find a job recently). And actually my income for the first few months already exceed the requirement income. What supporting documents we need to bring? Or any forms we need to bring? We bought a house and still paying for mortgage, can this be count as asset ? I am so concerned with this.

    3. For the criminal activities, will the interviewer ask about me only or my spouse too? Since my spouse has been arrested for domestic violence but the case dismissed later. I don't know if we need to prepare anything or bring anything?

    I can help with a couple things here. For the I-693, you should be fine, no need to redo. I had my GC interview just recently, and my medical examination was done in April 2018 and it was still valid.
    As far as the questions in the interview itself, most of the "revealing" questions are asked of the person getting the GC, not the sponsor. The interviewer will ask the sponsor questions about how you met or something along those lines, but as far as I am aware of, the sponsor's "criminal background" is not taken into consideration. With that being said, it may not be a bad idea to gather info about the charge and the dismissal. If a deposition is available, get it and have it just in case.

    If you have a lawyer, you should ask them about this. You paid good money to have one, utilize them to their full potential.

      1. You will likely need a new medical because when you submitted it the rule at the time was it was valid for one year from date of submission. The rule has changed to 2 years now but I DO NOT believe it was backdated to include pending applications.

      2. Unlikely they will ask or care about this. If they have questions about i-864 they normally send an RFE. If none was sent you should be fine.

      3. Bring the case deposition for your husband. If the io asks about it tell him the case was dismissed and give him the court deposition.

        For the I-693 it depends if the medical was signed less than 60 days apart from the time they received the document with I-485:


        If you did the medical exam and you sent it with I-485 less than 60 days after the doctor signed the form, then it is valid for 2 years.

              Thanks for your answers. For question 2. My sponsor status has changed. But we didn't inform USCIS once I stopped working. I think that is why they didn't send an RFE. So I am not sure if this will be a problem.

                Thank you so much for this information. My application was received 56 days after the the doctor signed the i693 form, and my i693 form was sent together with the application. According to what you sent it means it will still be valid. However, I called the Dr who signed for me last year, he said the exam was changed 10.1.2018 to a new one, so mine will be not valid anymore and ask me for a re-test. I am worried about if the interviewer also got confused. Can I just print out the official website and bring it incase the interviewer is confused?

                  Yes, you can print it and bring to your interview just in case. Just know that the IO has the authority to request a new one if, for example, you traveled to another country or visited an area with health issues.

                  And the information from the doctor: I don't think is true, the exam can change or even the form, but the document stays valid until it expires.

                    No it will not be a problem unless they ask. You can prepare a new i-864 and take it with you to interview just in case.
