  • Parents GC

Hi All....I need to start filing for my parents GC while they are here in US on a B2 visa since past 30 days. Need your support to clarify my doubts on following points :

    1) Do we need to wait for 90 days prior to filing AOS or can we start now for parents ?
    2) What is the timeline to get parents EAD & AP approval now ?
    3) I am a USC student with no income and no joint sponsor. Can we use my fathers cash savings to cover the Affidavit of Support forms ?
    4) Is it necessary to use a lawyer for filing their application for GC ?
    5) What is the lates timeframe to get parents GC ?

Will appreciate any guidance and support for you all.
    Thank you

    From what I read:
1.- there is no 90 day rule per se, the idea to wait that long is to make sure they don't think your parents entered the USA on a B2 visa with the intent to immigrate. But you can convince them to stay before/after those 90 days
2.- there are some reports (older parents) that many applications don't include EAD/AP. Personally I would include those forms even if the GC is approved quickly and EAD/AP never produced.
3.- I don't think for this case you could do that, but I can be wrong. Are the cash savings in a US Bank? Don't know if that could work but be prepared to find a joint sponsor.
4.- A lawyer is not needed if the case is a "regular" case. You just need to make the work, read and understand how to fill/file all the forms.
5.- I have seen 6-9 months for parents GC.

Remember that when you start the process they can travel abroad until the get in their hands either the AP or GC. Good luck.

Hi Enub4...thank you for your prompt support and responses to my queries. This really helps to understand the process.
Yes the cash is in US bank in the petitioner's account. So I believe this should work to substitute no income.
We do intend to file the documents after 90 days just to be safe although parents have used their B2 visa previously.
      Thank you once again..
