    Hi guys,

    As title, we are filing I-864, my wife's brother is helping us out so his proof of income and IRS documents has already been collected and ready to file. However, since my wife has just come to the US so she is currently unemployed. What proof of income or tax document do we need to attach with her I-864?

    She needs to attach her last year's tax return, and she also needs to fill in the "total income" number from her tax returns from the last 3 years on the form. If she didn't file for any of the last 3 years because her income was below the minimum threshold for filing, she would put "N/A" for total income for that year, check the box saying she was not required to file, and attach a statement stating her income and that it was below the threshold.

    She doesn't currently have income so she obviously does not need to provide proof of income. Since there is a joint sponsor, it doesn't matter that her household income is insufficient.

      If your wife just came to US then offcourse she doesn't have a financial history, If she came on H1/L1 type visa then she needs to complete 90 days before filling "Change of Status" in the meantime she'll have enough payslips to show as proof of income.

      If you are the joint sponsor, along with you Wife's brother then the same documents from both of you:
      1. Copy of W2 and Earning Summary (past 2 years)
      2. Copy of Recent Paystubs (past 2 months)
      3. Copy of Bank Account Statements (optional but showcases a good financial stability).

      Your questions is not clear enough to understand who is beneficiary and with is the petitioner.
