    Hello my name is Donald. Pls I need ur advice on this. I recently filed to USCIS (Marriage based) as a single status because when I applied for my US Visa into the US back in 2016 I was still single... I got a lady pregnant a month later after getting my VISA and we were forced to get married by her family few month later in 2016 and she applied for her US visa seeking she was going for honeymoon with me believing that we can make the marriage work; putting my name as spouse and date of birth in her application. Her visa was issued but she could not go for the honeymoon because things did not work out as we thought. In 2017 we got divorced few months after she gave birth. Some months later in 2017 she took our baby for an interview bcos she intend to travel with her (not- used yet) Visa putting my name as the father of the child and DOB.. The baby’s visa was issued. The lady (my ex) didn’t use her US Visa for almost 1yr $ few months but I did came to the state in 2017 and went back to my country. So late 2017 I was to attend an event in US.. She reach out to me that she will like to join me since she has not used her VISA yet and for the fact that we are co-parenting. So we came in together at the port of entry starting that we are here for an event. After coming in attending the event; we went our separate ways.. NOW DUE TO ALL THIS.. MY MINDSET WAS I HAD A SINGLE STATUS.. I got married to a US citizen so has to apply for my green card.. I decided since my Visa application back in 2016 was on Single Status I applied Single in all my USCIS Applications (Never married). After 3 weeks of submitted application with no biometric appointment yet.. I got to realized I made a MISTAKE OF APPLYING AS A SINGLE STATUS instead of applying Divorced and putting my divorced letter with my application. Now I don’t know what to do. Should I withdraw my applications and correct my mistakes by changing my status to divorced and adding my divorced letter and refile my application?? OR... WHAT IS YOUR ADVICE. PLS URGENT. Thanks

    Lots of words to keep track. Definitely consult a lawyer.

    3/6/19 - received by USCIS
    3/12/19 - texts received, checks cashed
    3/16/19 - receipt notices received
    3/23/19 - bio. notices for 4/4
    3/29/19 - biom. walk-in
    6/17/19 - EAD expedite request
    7/16/19 - card is being produced
    7/18/19 - EAD mailed
    7/19/19 - approval notices for EAD
    7/20/19 - combo cards received
    8/6/19 - ready to be sch. for an interview
    12/10/19 - interviews scheduled
    12/16/19 - interview notices for 1/14/20
    1/14/20 - interview & approval
    1/18/20 - card delivered

      My best guess is that you need to withdraw your application. Some information that may be helpful:


      Nov 2018 - Package sent - EB - Texas Service Center
      Day 1 - Package received at the lockbox
      Day 999 - Card delivered to me - Aug 2021

        The forms do not only ask if you are single, They ask about previous marriages, how long those marriages lasted and children blah blah. How you answered those questions should determine your next course of action. If you answered negative on those too then it looks like misrepresentation. It is not a material misrepresentation but the io can start wondering what else your hiding if you are hiding immaterial things.
