Received Denial for the I-601 but with Major Discrepancy

  • Received Denial for the I-601 but with Major Discrepancy

    Hello, after years of dealing with all of this we've finally received today a denial of our filed I-601.

    We've got 33 days to file an appeal (i-290b) from the date of the decision.

    Problem is, the date on the letter is: August 13, 2019.
    The postmark on the envelope is: September 05, 2019.

    Most of that allotted 33 days has disappeared in that large window.

    What gives?

    I also see the following mentioned on the instructions form for the i-290b:
    NOTE: If we sent you the decision by mail, the “date of service” is the date we mailed the decision, not the date you received it. See 8 CFR 103.8(b). Decisions are normally mailed the same day they are issued.

    May I ask why did you need to file I-601?

      Look up 'Extreme Hardship' if you're curious.

      All in all, this is due to a stupid little lie told 25 years ago which is haunting us till this day. The fact that USCIS is hung-up over something so stupid for a person who's worked and paid into the system (with a valid Social Security Number) over a span of 50 quarters and has never gotten anything more than a jay walking ticket is utterly tragic.

        Did you use a lawyer? if not time to lawyer up immediately.
