  • i864 Joint Tax Return

    Hello,
    I'm currently looking for a job on my OPT and my USC wife is not working. The last time she was working was in 2015. So we dont have income right now. But we do have joint sponsor for my application. I did work when I was in school and when I file my tax return, I do it jointly with my wife. So my question is what should my USC wife put on her i864 form if we have joint tax return but her income is 0?

    For the question for her current individual income (Part 6 #7), it would be 0, and her current household income (Part 6 #20) would also be 0. For the question asking for the "total income" number from her tax returns for the last 3 years (Part 6 #24a-c), she would put the exact number that is on the "total income" line of her tax returns for those years, no matter if she filed jointly or not. So if she filed jointly, that "total income" might include your income, but she still must put that exact number.
