  • Last Address Outside US (works in US but maintains foreign residence)??

    Hello All,

    We are getting ready to submit our AOS package and I have a question about form 485, part 3, 9-10. I am a US citizen and my husband is from Europe. He has been living and working (legally) in the US for the last 10 years as an O-1 visa holder. He has maintained his foreign residence abroad as we have gone back often in the last 10 years (mainly to fulfill his 2-year home residency requirement as a result of his J-1) -- but never for more than a few months at a time.

    We are unclear about how to list the dates of residence under the section for "the most recent address outside the US where you lived for more than one year." He has lived in his home abroad since birth but not sure what to put for the "end" date since it is still presently his foreign residence (even though he lives and works in the US).

    It seems we have 4 possible responses:

    Leave the end date blank?
    Put N/A?
    Put the end date as "present" since he still maintains the home there?
    Or put the end date as the date he first arrived to study/work the US some 10 years ago? This last option doesn't feel excatly right since he has been on a temporary, non-immigrant work visa.

    Confused - please help.

    who lives in house when he is away? I would put the end date as 10 years ago . He only visits now for vacation (wink wink)

      Thanks for your response! It's actually his house (older family is deceased) and it stays closed and locked when we're in the US.

      It was suggested to us that we list the dates of residence as birth to present -- as a "concurrent foreign residence" since the home is in his name, we pay foreign property taxes, etc.

      Thoughts?

        didoesque the most recent address outside the US where you lived for more than one year : this is before he moved to US and started working so you can put the day when he entered in US as his last day in the foreign address. after he moved he never stayed there for more than a few months.

        Relax, in the grand scheme of things it wont matter, he will definitely have questions regarding his J1 and he can explain the situation if asked. they will be more focused on the recent address and supporting documents. the older address are mostly used for verification purposes.

        Make sure to double check the forms and associated signatures and check the fees you are sending. anything missing will get you RFE or RFIE and that will delay the process. Good luck.

          Thanks so much for the clarification. We were unsure about the end date on the form because we didn’t want it to seem that he abandoned his foreign residence since that is his “permanent” address as of now. We have documentation that’s about 8 inches thick re the J1/completion of the two-year requirement. Will double check everything you mentioned. Thanks again for your response!
