  • EB1 India - PD - May 2017

    Hi all,
I am reading on forum that on Oct 1. EB1 India will go to Jan 2015 and can go to Feb 2017. Feb 2017 would be for OCt or for whole year ? My PD is May 2017, when can I expect GC ? are there chances to get it in Oct/Nov this year ?

The visa bulletin for October put EB1 India as 01JAN15 and the notes say "India: Little if any forward movement", so no, there are 0 chances that you get GC in Oct/Nov this year.
You will have to wait a few months to see if there is any movement or any changes in the law so your date moves forward more than 2 years for you to get the GC.

Thanks for clarification. I didn't know this. I was thinking that I would get it in Oct. Is there a way to expedite the process, such as premium processing ? I think our medical will also expire by then, might have to do it again.
Is it okay to travel to India ? I was thinking of getting GC and then travel but now it would take too long to get GC. I am on O1 visa and got paroled in when I traveled to Canada. My family has not done their parole. Would it be make better to go to Canada and get the paroled in before visiting India ? Is there any risk in visiting India ?

I don't think there is something you can do to expedite the process.

I don't understand why they did such retrogression, I expected the dates to get back to what they published in May. I don't know what is going on and I hope the dates move forward in the next few months but there is no way to know until we get the new bulletins.

If you were paroled going back from Canada, then you are no longer on O1 visa (I think), because O1 is a non-immigrant visa. I don't think it matters if you travel back from Canada or India to get paroled. As long as you have your AP and it's valid (return before expiration), you should be fine. Everyone traveling must have their own valid and un-expired AP document.
