    Hello everyone,

    Please my situation which is killing me softly.
    I have been married to my wife for 5 years now, (a US citizen) and I am going through a AOS for over 4 years now. My case status had been interview completed and case being reviewed after 2 interviews by different Interview Officer. My problem now is that my wife is into Bigamy, she now live with a different man and still have most of her things in my house also legally married. She streams video both hanging out and pictures on ******** and removed my access from seeing them. I had to view through another account.

    Sometimes ago, she came home and realized I wasn't home, she threw all my belongings out and when I came back the next morning, she threatened to stab me which I ended up calling the police. Upon police arrival, the officer concluded that I move out of my house, a house she doesn't contribute a dime towards paying the bills, I have been paying rent and other bills alone ever since we got married. I returned to my apartment after a week of sleeping around and she's been gone since then but only called to apologies and to ask for money. She don't have a job for over 3 years now.

    My case is still pending, I don't know what step to take, I could have filed for divorce. She has took the new guy to meet some of her family and now parade their-selves around as a couple attending family occasions while we are still legally married.

    Please I need your sincere advice on what step to take to help me out of my situation cos I'm really in crazy situation at the moment. USCIS may find out of her ******** account and use that as a leeway to deny my application and I heard bigamy is a felony and punishable under law. Can I report this situation myself before they find out?

    Unless she is married to the other guy/s it is not bigamy. File for divorce and move on. If you have been abused by her you can try for a VAWA green card. Your current case will not be approved unless things change drastically between you and your wife.

      Did you come on K1 or some other visa?

        Thank you for your responses. newacct I came here on B1/B2 visa and filed for AOS in 2016 which was denied in 2017 for not submitting enough evidence. My wife Tax return was filed as Head of Household for that year and the IO was so mean and denied the case. So, we reapplied for i-485 same month the initial application was denied and got another EAD within 2 months. Got interviewed after 6 months and never got approved until another one year when we got scheduled for another interview which is in early 2019. Lo and behold, we got another IO assigned and did normal fresh interview, IO said, will need to review the case and status has been Case is been reviewed. She started hanging out with this guy since this year before i know it.

        My worry is if i decide to move on now, this will definitely affect my application if divorce is filled. I have some document to back up VAWA as azblk said but i dont know if its enough to win it. Its just police report and some pictures of her cheating and how she destroyed things in the house. Do you think filing VAWA can affect my pending application and also do you think I have enough evidence for vawa?

          This is the thing you can be proactive and take your situation on head first or you can wait to see what the USCIS will do. It is unlikely that after all this time they will approve your case and from what you have described it seems you have irreconcilable differences and it unlikely this marriage can be fixed. IMHO is divorce this woman and start over again with someone else

          VAWA is about abuse and personally i do not think that a cheating qualifies as abuse but that is just my opinion. No VAWA will not affect your pending case unless it suddenly gets approved but even then I think you can withdraw the VAWA.
