I have entered the USA on a fiancee visa and got married within 90 days. Now I am applying for green card and filling out work permit form I 765 at the same time.Question 16 got me confused should I chose (c)(9) as Adjastment Applicant or (a)(6) as K1 non-immigrant fiancee as an answer?Thank you for your help.

Thank you, for your reply. I am within 90 days of entry but I am already married and I am not a fiancee anymore. I also know that a fiancee may apply for a work permit before she gets married, however, in this case she will be ligible to work for 3 months only(I suspect it's (a)(6)). If she applies after marriage as Adjustment applicant she gets work permit till she gets her green card which might take longer than 3 months(this might be (c9).Can I apply for c9 even though I am within 90 days?Sorry if I am being confusing

I filed the I-765 for my Wife who entered the US with a K-1 fiancee Visa. She was only fiancee when she arrived. We married two days after she arrived in the US. We filed I-485 and I-765 about a month later. I was more concerned with getting her on my benifet plans from work.
I used (a)(6) K1 non-immigrant fiancee VISA as the answer for question 16. Her card is valid for a full year.My Fiancee arrived here on a K-1 VISA.
Conditional GreenCard has been received.

hi mysh22. i have the same situation as you. what i chose was the C9 beacuse if you apply for the a6 you will have to apply again after 3 months because the card that will be given to you under a6 will only be valid for a short period of time. unlike if you chose the c9 you wont have additional work in reapplying again after the card expires. you can choose the c9 even if ur still in the 90 day period. what you just have to do is file your I-485 concurrently with the i-765.Last edited by cher; 04-08-2010, 07:56 PM.
