  • Traveling within the US with I-485, EAD and travel card pending

Has someone traveled to Mcallen, El Paso Texas, or has encountered a border patrol with a I -485, EAD and travel card pending?
I was told by my attorney that applying to adjustment status I-485 would allowed me to stay in the USA without any problem. Also that I could travel around the country. I have traveled by plane and car to several cities and have not had any problems at all. Now I want to travel to Mcallen and El Paso texas and since I thought there would be more border patrols I decided to call my lawyer. Now she is telling me that I can travel under my own risk, and that If I encounter any patrol border officer I could get arrested. So right know I don't understand...the process of adjustment status allows me to stay in the USA and at the same time I should not be here?

I arrived to USA in November with a B2 tourist visa, legal entry. I married a us citizen in March. Applied to adjusment of status, EAD and travel card in April.

ahrr0316 , this is a very controversial condition, pending 485 means you can stay in US ( you cant work unless you have 765) but that is the extent of that. unless you have another valid in status condition (J1, H1B) etc with proper i94 it is RECOMMENDED not to encounter CBP at border checkpoints or Border Towns. they can deny you rights and arrest you if they feel like it.

i would recommend you do not visit the border states until you get your EAD/AP or better yet GC.

I agree with Stormlead86 - I would avoid border patrol if you can help it until you received EAD/AP or GC.
