  • Resubmit I485 but immigration status from F1 to H1b, how should I modify it?

    I submitted I485 in August but the package was returned by USCIS due to not reaching priority date. Now, the October VISA bulletin shows my catalog is current and I'd like to resubmit it again. Other people just included green sheet of paper and I-797. However, my VISA was changed from F1 to H1b in September. How should I deal with it?

    1. I just modify I485 PART I, 24 "current immigration status" to H1b on the same form? Or I need a new form?
    2. Do I need to have a new signature (10/01/2019) on I485 form ?

    Did you use the latest form I-485 version? They will accept the previous version only if it is postmarked up to October 14, 2019.

    What I would do, make sure it is the latest form, then change the pages that you will update. If it is the previous version, then I will use the new version and won't use the one sent in August.

    Do you have the medical exam form I-693? If the civil surgeon signed the form more than 60 days before you submit it with the new I-485, it will not be valid and you will need a new one. Good luck.

    EDIT: If the form says 07/15/2019 on the bottom left corner, then that form is only valid if postmarked up to October 14, 2019. As of today, there is no form available to send it on October 15 or later. Thank you newacct

        They should have the latest here: https://www.uscis.gov/i-485

          The latest edition is the edition that is only accepted if postmarked up to October 14. The edition that will be accepted if postmarked on October 15 or after has not been posted yet.
