  • I-485 interview if sponsor loses job, but immigrant has a job?

    05/23/19 Receipt date I-485, I-130, I-765, I-131 -- marriage based, NBC
    06/13/19 finger prints
09/24/19 Courtesy letter: missing I-693, please bring to interview
10/01/19 Interview Ready to be scheduled (likely in Baltimore)

    I have two questions:

    (1) I am getting nervous because my husband (American citizen), who is my sponsor, may lose his job. I am working a better-paying job on an H1B, and could prove I can continue this job after a Greencard is issued. Would, given we are married and live in the same household, my income count as proof of income during a Greencard interview, even though in the original application we had my husband as sponsor? If yes, could I just bring a new I-864 to the interview signed by me? Or would the case be denied if my husband cannot sponsor me and our 2 kids?

    (2) I'm happy about the "Interview Ready to be scheduled", but how long does this take? Baltimore MD shows a wait time of 13-33 months. Is this from the NBC arrival date? If yes, i would still have to wait at least 9 months for an interview.. I hope the I-765 and I-131 will get through soon... I'm happy I waited with the I-693. I'll do it once I receive an interview date, so I will not pay twice.

Thanks y'all!!!! I feel so sorry for all of you who are losing money on these long wait times. I know I'm lucky being on H1B...

    1. Yes, you can use your current income for this purpose.
Just an opinion; Not legal advice.
