  • Case under review for about 3 months, Minneapolis-St.Paul Office

Hey guys, just wondering if anyone is facing a similar situation. My wife (chinese national, petitioner) and I (mexican national) filed for aos in february and wen to our interview on june 20th @ the minneapolis- st.paul office. The interview went well, except that our i693 was outdated (civil surgeon used an outdated format) got RFE a few days later and sent updated i693 about a week after. The case has been stuck in "under review" since. Our lawyer told us that there were some backlogging issues, can anybody confirm?

        Did you file as cross-chargeability?

I have read many posts that when people receive an RFE after the interview the case can take up to 120 days to be approved (after they receive the document). I hope you get your GC soon.

Yes, we did. Certainly hope that our documents arrive soon, the wait is stressful and the lack of stability always makes me wonder "what if?". Thank your for the good wishes, blessings.

There were certainly EB2 RoW backlogs (not sure about other countries) around mid July - Sep. Since you interviewed in June you should have avoided the retrogression but you got RFE-ed which meant your case would probably re-evaluated during the period that retrogression hit. Since it has become current again in Oct I think you should hear back this month.
