    Hi,

    I am applying for I485 (employment based) and came across the question about the former spouse. We parted ways couple of years back even before coming to US. There is a court letter and that is with my former spouse. There is no contact. And no other letter.

    Should i mention this marriage in I485?
    If yes, will they ask about any documentation or will it impact my GC?
    If no, will they find out?

    I will not feel good if interviewer start asking me questions about my former spouse in front of my current spouse and kids.

    Suggestions please.

    You must mention it when it is asked on the form, because you must answer all questions truthfully.

    Documentation of it shouldn't be necessary for your own GC, but proof that the previous marriage ended will be needed for your spouse's GC if your spouse is applying for one, since it is necessary to show that your current marriage is valid.

      Yes you definitely need to mention your former marriage on your I-485 application. You need to show proof that you got divorced. The question if they would find out doesn't really matter because you sign the I-485 declaring that you answered truthfully on every question. If you do not mention it and they find out, you will definitely be denied.
