  • Strange Medical RFE

    Hi all,

I was nearing the end of my green card journey (had green card interview on Aug. 29, 2019) until I received an RFE that didn't make sense to me.
It was a medical RFE telling me that my I-693 was invalid according to the new rule enacted on Nov. 1, 2018 and that I would need to complete the medical form all over again.
After reading the rule over and over again.. I don't understand how my medical form is invalid.

I completed my medical and got it signed on Nov. 7, 2018.. so under the new rule I would need to submit my I-485 application within 60 days after this date for it to remain valid correct? I don't remember exactly when I officially submitted the I-485 but it was around a week before Christmas. To check for certain, I shuffled through my I-797 NOA's and found the I-485 notice stating the received date as Jan. 04, 2019. So USCIS had received my I-485 application 58 days after the I-693 signature. 59 even if you count that last day.

So what's going on here? Is it possible that USCIS make a counting mistake or am I missing something here?

It's so frustrating having to waste time going through another medical, especially since mine isn't even a year old yet sigh.

Yes, maybe they made a mistake but in this case, I think is better to waste some time and money and give them what they want.

You may get a discount if you go to the same doctor, explain that they say the form is invalid. Make sure they file the latest I-693 form.

I don’t think arguing with USCIS a good use idea now. Just get medical exam done again and submit to them. It doesn’t cost that much because you already vaccinated. Good luck

Hi everyone, had my interview a month ago. Everything went fine but she said that she needs a new medical and told me to go to the doctor ASAP, so I have it ready by the time she sends me a notice request.
so apparently, the medical expires in 60 days from the day when it was signed by a doctor.
i have 30 days left to submit it and I was wondering if I can just submit it without there request notice, has anyone done that?
