  • Hello,

    I am new in this thread and I would appreciate advice from any of you so much. I am adjusting status from immediate relative from F1 Visa. I passed the biometrics and I just received a Yellow RFIE. On it, they ask me to submit a copy of the birth certificate of the applicant (is it me, the beneficiary? or my USC husband, the petitioner?).
    I already sent a copy of my birth certificate on my original package along with a certified translation (from Spain). Does anyone know why I got this RFIE? I seriously appreciate some help.

      I am on F1 status now for masters degree.
      I completed a PAID internship (66 days) (within my field of study) in the Summer before graduation (undergrad) , I am realizing it was unauthorized because it was not under CPT.
      Left the US after graduation, now I am back for grad school under new I-20 and sevis record. A company will start the h1b process for me soon.

      Do I notify them of what happened?

      Will I get automatically rejected?

      Does the 245k apply to h1b?

      Does the 180 day rule for unauthorized employment work under h1b?
      I always worked on campus and this was my first internship. I never did CPT or OPT.

          • I received my RFIE. They are saying that I have to submit affidavit of support proving that my income is 125% of the federal poverty guideline. I filled application in December for my wife, she does not work because I do. I filled affidavit of support. We have been married for 3 year, and I submitted joined tax returns for the last 3 years and each of this years I made at least 85k per year. I submitted joined bank account that by itself has more savings that federal poverty guideline. So this request does not make sense to me. The only thing that comes to my mind is that I filled in December, which means that my most recent tax return was for 2018. I'm planning to submit 2019 tax return, once again print out for the joint bak account, all pay stubs from 2020, letter from the employer proving that I'm currently employed and mentioning my annual salary. Did anyone had such situation? Do I miss anything from the documents that I'm planning to submit?

            12/11: USCIS received package
            12/21: Hardcopy I-797 NOA received
            12/30: Biometrics Appointment Notice Received
            1/7: Biometrics completed
            1/29: Case was updated to show fingerprints were taken
            2/4: RFIE was sent
            2/8: RFIE was received
            2/18: Send a response for RFIE
            2/20: USCIS received RFIE response
            3/4: Case is ready to be scheduled for an interview

            • 85k is more them they are required. In December 2019 and January 2020 people are unable to provide a taxes for current year. It’s impossible!
              21.138 FPG 125% for 2 people
              26.663 FPG 125% for 3 people
              When I sent my packages I provide 3 months current pay stub and letter from employer!

                What income are you filing ? Self employment or a regular job?
                also how many dependents do you have even if they dont live with you?

                  Hi, we had a similar RFIE. My husband is the petitioner and sponsor. First, we went back to our original package (we kept a copy of it) and we realized what we did wrong: instead of submitting tax RETURN transcripts we submitted tax ACCOUNT transcripts, so whoever was reviewing our file didn't like it because of that. I read somewhere that if you sent the wrong tax document, the USCIS doesn't have a way to prove that you qualify as a sponsor, so they send you a RFIE because of that.
                  Our RFIE asked for W 2s and any other tax schedule for the most recent tax year. We submitted our application in October 2019, so the most recent tax year for us was 2018, and it is still because we haven't filed 2019 yet.
                  They also requested for a joint sponsor, but we don't need that because my husband's income is well above the poverty guideline.
                  This is how we responded to the RFIE:
                  -sent w-2 AND IRS tax return transcript (online) for the most recent tax year (2018).
                  - sent a cover letter explaining that my husband is above the poverty guideline, so he does qualify as a sponsor. In order to prove that, we sent an employment verification letter+ four months of paystubs.
                  Our response worked because we were scheduled for the interview less than a week after they received it.

                    Hey vic,

                    Was your letter pink or yellow? If it was pink is because something was wrong with the former documents that you sent, if it is yellow they might have lost your documents and it is just a matter of resubmitting

                    Dec 22 received 2 hard copies for NOA
                    Dec 30 Received biometrics appointment Notice
                    Biometrics done, January 2nd.

                      The same exact thing happened to us, but we submitted the tax returns with all the schedules, however no employment letter or pay stubs, our attorney handled it and he filed the response back, the response was recieved december 12th, still no update to this day! Which is worrying me!

                        That's what our lawyer said , that they might have misplaced the documents we sent, we got a yellow on, but still haven't recieved a response since December 10th ( response to rfie recieved) which is making me very worried.

                          Have you tried calling a tier 2 officer?

                                It is yellow. But I'm still planning to submit little more stuff on top of what I've sent originally just be sure. And I've got my w2 for 2019, and I have access to all my paystubs online
