Good evening everyone, we had our interview this morning. It was around 1 hour and 30 minutes long. Our IO was friendly but very direct. We were a total of 4 people in her office, hubby, me, attorney and interpreter. IO reviewed both our I-130 and I-485. We didn't get approved at the end of the interview. We were told that our case needed to be reviewed and that she should make a decision between 7-14 days. Gave us 2 sheets of papers. One was a notice about our case needing to be reviewed and 2nd sheet was instructions about getting our conditions removed from GC if approved. I felt very stressed, even though the focus was not on me. She only asked me a very few questions pertaining to the I-130 and my previous marriages and why I divorced them, my kids and how we met. My hubby was a total different story. He got bombed with questions from the I-485 application plus all his entrances and overstays. She went over all the dates he came in and out. And what he told other officials every time he came in as a B1/B2. She questioned all the time frames in between entrances and exits. Where he lived, where he worked. How we met, why we marry. And to make things more stressful it seems like our file was messy in terms to documents not been in the correct packages. Ex. some addendums from I-130 were not in that packet, but in I-485 packet and viceversa. So she kept asking him why is this not disclosed in your application? Attorney had to intervene to tell her it was sent in, because she had a copy of our file. So at the end IO did find all of the stuff she thought was missing. I think that between that and translation it made the interview longer than normal, but who knows!!!. At the end our attorney told us we did good. That she had no reasons to believe we will get denied. After IO finished the interview she asked for his medical, and supporting evidence.
Also, we had a waiver filed on his behalf because of the overstaying, working with no authorization and misrepresentation. (I-601) So let's hope our attorney is right and we get a positive outcome.Last edited by MGarza78; 02-20-2020, 07:18 PM.B2 Visa Overstayed-Concurrent Filing AOS

we actually didn’t send much in with our application. We provided the standard required documents such as birth certificates, naturalization certificate, marriage certificate, taxes and W2, etc. Re: Bona fide marriage evidence- we just provided a leftover wedding invitation. That was it. I was expecting a RFIE and was pleasantly surprised when that didn’t happen. However at the interview we showed up with lots of evidence:
1) legal documents (birth certificates, naturalization certificate, passports, marriage certificate)
2) recent bank statements from joint account
3) recent joint bills (cell phone, cable)
4) all 2019 & 2020 medical and life insurance docs showing my spouse on my coverage
5) 401k showing spouse as beneficiary
6) indexed list of all trips with hotel and plane receipts
7) pictures- with family, friends, us engaged in activities, wedding pictures (the IO was really interested in the wedding pictures and wanted to see if our families were present at the ceremony)
8) wedding related receipts (reception, ceremony, etc)
9) financial documents- 2019 taxes- filed jointly, my W2 as the sponsor, letter from verifying my current salary
