    Hello,

    My wife is American and I’m Brazilian. I entered US with a K-1 visa and we married a couple of months ago.
    After that we started the process for the Green Card and Work Permit (I-485 and I-765 C9). Right now we received a ‘Request For Initial Evidence’ asking to submit all supporting tax documentation that she has (W-2s, 1099s, Form 2555 and all supporting tax schedules). But she doesn’t have any of those, as she lived most of her live out of US (she has double citizenship)
    They also stated that she doesn’t meet the 125 percent of the federal poverty for the petitioning sponsor’s, but she started to work as a pediatrician in June 2019, so she meets this requirement.
    The only problem is that she only has hers paychecks to prove that she earns that money, since she didn’t do any tax declaration yet.

    Could you please advise what can we do here?
    If we send to USCIS only the paychecks, would that be ok?

    Paychecks and a letter from her employer stating her salary should be enough to establish that she now earns enough.

      I’m sure in that request for evidence letter from USCIS they mentioned, 6 months paystub and job letter stating hours worked, annual salary, nature of work, prospects for advancement and number of years employed should be forwarded as evidence of current income.

      Also, you can be proactive and document all the reasons you gave above for not having the documents you would be comfortable submitting and forward it along with those documents you are able to provide.

        Hey, I'm from NYC too Queens my PD is August 19th, 2019 .. didnt receive anything yet beside biometrics completed and reviewed.. your file is in NBC??
