I485 denied

Just got notice that I485 for my spouse is being denied (text message). I don't have the letter yet but I am guessing it is going to say that it is missing the I-864. I see someone just posted that they were denied I485 for same exact reason.

I figured out I forgot this a couple months after sending and on advice from the forum I decided to wait for them to send an RFE for this. Well they never did. Ironically we just got the approval notice of the I130 last week.

Looks like my best option is to refile the I485, I765 and I131 (travel) since it is our mistake. The wait was already very very difficult on my wife.

Questions:

1. Can my wife stay in the US while we refile the I485 since the first one was denied?
2. Does this mean that she would have to wait for approval of I-485 (around another 5 months) before she can be approved to travel home or work
3. Not sure if recommendations can be given for Chicago area immigration lawyers but share if you can

Married right before end of 3 month ESTA
February - in package with I130, I485, I765, I131
March - Package returned filled out incorrect payment amount missing biometric fee
April 1 - Accepted package of I130, I485, I765, I131
August - RFE for I130
October 15 - I797 notice approval of I130
October 22 - text status denied I485

I also had my I-485 denied because they claim they never received payment for it and that they sent me an RFE, but they NEVER did.
Based on my experience, unfortunately, your wife will have to wait for another 5 months or so to get her EAD. The good news is that they keep your PD based on I-130. She will also need a new doctor's sealed envelope and make sure everything is up to date to avoid RFE's because that can delay her EAD process.

That was really bad and now costly advise not to send i-864. You should have sent it with a copy of i-485 receipt the moment you figured out you forgot to send it. USCIS can now deny without sending RFE in incomplete cases. That being said you can apply again if you had not been put in removal yet. It is also the new policy to put one in removal after a denied application if they are out of status at time of denial. If you are applying again make sure you do it right this time and try to file as quickly as possible - double check everything current forms, evidence and accompanying forms.

You can get the shot records, no need for new shots (not including new Flu shot).
You may get a discount if you go to the same health provider, but some charge full price even after a few months. Good luck.
