  • re-entry permit - permissable or not..

Hi all, I wanted to know, I have sent in my form I-485 and the I-130, based on marriage to USC, I did not send in form I-131, because I did not want an advance parole, however, I would like to apply for a re-entry permit, I have just done my biometrics and have not done my interview. Can anyone advice me, as I am thinking of applying for re-entry permit and submitting fomr I-131 before my interview, would this be wise and can I do that without yet receiving an approval for adjustment of status... please advice... thank you very much...

    Don't mix up!

May I ask where did you come up with this re-entry permit idea? There is no such a thing for I-485 applicants. Once you file for AOS, you are under the supervision of USCIS. If you leave without having an approved AP regardless of your status, your application is considered "abandon" and it is administratively closed by USCIS. You have to stick around until you get your AP approved or get your AOS approved and you have a green card in your possession. There have been certain cases where people with even AP have had problems re-entering the USA. So you decide, what is better for you. My comments should not be considered legal advice. This is just my opinion.
