  • A very weird 485 interview

    Had the AOS interview this morning. I’m Emplloyment based EB2. Appointment was for 11:30 at the NY field office on the 7th floor. But waited until around 1:30 & the officer was quite a character. Anyhow, he really wanted these docs which I happened to not have with me: last 3 month paystubs consecutively (even though I have three stubs of 2019 one being from Sep, three of 2018), he wanted W2 of 2017 & 2018, & Tac returns of two years. I had W2 of 2018. Is this some kind of mandatory documents? So, he left me with a CONTINUANCE notice, with the 2nd box checked (priority not current) & ASKED MY LAWYER TO DROP OFF THESE PAPERWORKS AT 8:45 in the next few days (before he starts his interviews of the day). So the undertone is he is not mailing the AOS package to the service center until he got these. So now we are scrambling to figure how to get to the Plaza in lower Manhattan at 8:45. But 1) is he supposed to mail out the physical package or simply send an electronic package to the Vermont/TX center 2) is he going to hold on to my package until these tax returns are provided?

    3/12/19 - texts received, checks cashed
    3/16/19 - receipt notices received
    3/23/19 - bio. notices for 4/4
    3/29/19 - biom. walk-in
    6/17/19 - EAD expedite request
    7/16/19 - card is being produced
    7/18/19 - EAD mailed
    7/19/19 - approval notices for EAD
    7/20/19 - combo cards received
    8/6/19 - ready to be sch. for an interview
    12/10/19 - interviews scheduled
    12/16/19 - interview notices for 1/14/20
    1/14/20 - interview & approval
    1/18/20 - card delivered

      Your attorney did a poor job in guiding you. EB- you should more than expect to prove that you are receiving ‘pay’ continually and paying taxes - which would mean you’d have walked in with all your tax returns and year-end W2 (usually 1 per year) unless you have multiple employers and multiple switches. Drop them off, ASAP, or risk denial? The ISO would have provided you a ‘pass’ or a note to allow you into the building again; if not check with the reception desk - they can usually contact the ISO. ATB

        Honestly there is no absolutely list of docs that people all agree on. On the earning/tax aspect, I was under the impression that some “recent” paystub & W2 are sufficient, while complete assortment of paystub & past two year tax return scans are optional. But this officer wanted to be thorough I guess.

          I think he is trying to be tremendously helpful to you! I am so sorry but you supposed to already have those docs with you. He could have told you to just mail the documents or wait for RFE rather he is giving you a chance to save time and basically hand the docs. I would be so so appreciative of him for being so nice.

            I also got the feeling he is actually trying to skip the red tapes & allow me to personally hand him the paperwork’s. My lawyer got the same impression. We’ll drop them off on Friday, meanwhile the officer is holding onto my package without mailing it to the Center.

              My priority date is not yet current (although appears to be close), the interview was on Monday, & me & my lawyer will drop off the docs on Friday.

                Handed in the missing docs today, the officer was nice & waited at the door at the agreed time. Now I just have to monitor the bulletin for my priority date.
                question on background check: I’ve been on H1B for six years now, & previously F1. This will not be the first background check they perform right? When I changed from F to H1, was there a background check, then at I485 (fingerprint), there was a check? This would be the third one?

                  Why it matters? First, second, tenth. Everytime you enter the county you go through a background check too.
