  • Expedite I-765 or EAD Card

    Hey guys.

    Thanks for your help.

    I am trying to expedite my EAD card. I know it is case by case basis.

    Do you know how to proceed ? I am calling USCIS to request it, but it doesn’t give me the an option. Does anybody know? I haven’t found a way to do it online either.

    I am married to an US citizen, and I have filed for AOS.

    Hi,

    You need to call USCIS and find a way to speak to a representative regardless (It took me awhile to click the numbers on my phone to be able to speak to someone). Then just go ahead and tell them you want to request to expedite your EAD. The representative will ask you some basic information regarding your current immigration status, then will ask you why you want to expedite it (I said that I enrolled back to grad school and needed to work to pay for my tuitions, even with the financial help with my spouse, tuition is expensive in this country). If your spouse is also sponsoring you financially through I-864, just make sure not to give them the impression that your spouse is unable to help you financially at all.

    Then once you tell them why you want to expedite, they will put it in their system, and someone will contact you through email asking you to fax over the evidence (I received the email in less than 2 weeks, I faxed over my tuition bill, my bank statements, and my spouse's pay stubs). They approved me a little over a week after I faxed over everything.

        Hi, yes I was. I was working on OPT for a year. I got married before the OPT ended. Then I filed the AOS 3 days after the expiration date of my OPT.

          tmao923 Thanks for your sharing you experiences. I am currently on F1, no OPT. You think it will have chance to make an expedite request? I am unable to work legally, but you have to prove those things. Also I am paying for school. However, I was thinking, as an F1 student you come in and study as someone who has funds to cover studies (states on I-20), so I'm not sure ho you were sucessfully use this still. What would you recommend on my end? Any tips welcome friend :-)

            I see your concerns, I-20 does need you to have funds to cover the tuition as a student. However, when I filed for the AOS and then requested to expedite, I was no longer a F-1 student (my OPT has already expired, I never renewed it, therefore I had given up my F-1 status). I became a "pending permanent resident" when I received the receipts from USCIS, and I was actually able to get In-State tuition with my status. In your case, I know that some people suggest to keep the current F-1 status while the AOS is pending, but unless the marriage is a fraud or there is a mistake in filing, in my opinion it is unnecessary to keep the F-1 status.

            How long has it been since you filed the AOS? When you are a F-1 student, you need to prove that you have financial help from others (mostly parents). For AOS, if you list your spouse or anyone else on your I-864 other than the ones from your F-1. Then ultimately the USCIS is mostly considering the money source listed on your I-864 instead of the F-1. Also, I don't think USCIS actually cares that much that you are still a F-1 student, like I mentioned above, as long as you entered the country legally and received the AOS receipts from USCIS, you are considered as a pending permanent resident. As long as your reason to expedite is legit and valid, they will consider to expedite it.

              I am currently still an F1 student and maintain my status. My pd is Sept 20 and Oct 8 my review of fingerprints was completed at the NBC. I filed my expedite request however today with a tier 1 officer over the phone (first person you get on the line). I will wait now for an email with a decision or RFE for expedite request

                Hi Guys,

                Just a quick update. With my PD Sept. 20, my review of biometrics was completed Oct. 8 for both receipt numbers.
                I have gone ahead last week on 10/31 by raising an expedite request over the phone with tier 1 representative. I closely explained the reason under financial hardship to an individual. Then, I was provided with a tracking number. I am awaiting either an approval, refusal, or RFE (which will be the likeliest case). No status update on neither of my receipts, nor email notification received. Will update you guys soon!
