  • I485

My i130 was approved in April, 2019. And was told to apply for i485. I was told by the filed office not to apply for EAD Cuz it will take same amount of time and adjustment of status which is about 2-3 months. So keeping that in mind I applied for i485 in June. I had my bio-metric taken beginning June and I haven’t heard anything since then.

can anyone help me what I options I have? It’s been alomst over 4 months.

I think someone gave you the wrong information. From many posts that I read and personal experience, filing for EAD will not delay AOS process and AOS process is in exceptional cases a 3-month process. AOS is usually 9 months or more.

4 months with no news after filing AOS is very common for people that sent all the required forms/information.

If you want to check the estimated time for your case, visit https://egov.uscis.gov/processing-times/ select I-485 and for field office your nearest city. If you have several nearby check the other too, sometimes they assign one office or another one.

That was very bad advice. I cost nothing but 2 passport pictures to apply for EAD so you should have applied for it. You can still apply for it now with a copy of your i-485 receipt notice. It might take the same time or it might not. NO ONE even the field office knows how long your adjustment will take so unless they give you something in writing take it with a grain of salt.

will agree with Enub4, only exceptional cases will be adjudicated in 3 months. now a days they are scheduling interview in 3 months (im one like those) and giving EADs in 8 months. So no clue how they are doing things over there.

After bio-metric it is common to not hear anything for 3 - 5 months, unless you are in the field offices like Seattle or NYC you should expect to get scheduled for interview by 8th month.

Still i would suggest follow azblk advice and submit for 765, after they receive you can always request an expedite with valid cause. Best of luck
