  • Removal of Condition 2020-AOS-Marriage

    Hello everyone,

It has been two years and a few months since we received our 2-year conditional green card-AOS through marriage. We have already marked our calendar for the date when we will send our documents for the removal of conditions, which is at least 90 days prior to the original date we received the GC, 07/31/2017. We have moved from Florida to New Mexico and have already updated our address with USCIS. We anticipate sending our documents to a new office and though we had a seamless process so far, please see this link (https://www.immihelp.com/forum/adjus...a-pd-july-2017 ) we are realistic. We can very well be one of the random persons who will be called in for a second interview (USCIS selects random persons for a second interview; these individuals might have either an A-C case rating, A being unproblematic case, B- acceptable case or C being questionable/reasonable doubt). However, I am just checking in (it has been two years and a few months since I got on immihelp) what have your experiences been throughout your process of removing conditions-AOS-Marriage?

It should not be "at least 90 days" prior to the 2-year mark. It needs to be less than 90 days prior to the 2-year mark, or they will reject it.

This is my personal opinion and is not to be construed as legal advice.

Thank you for responding. Yes we are aware of the technicality of this 90 days submission. Based on the USCIS website our intention will be to send it just so it fits within the 90 days, not before and definitely not after.

USCIS states: When Should I File Form I-751? 1. Filing jointly. If you are filing this petition jointly with your spouse, you must file it during the 90-day period immediately before your conditional residence expires.

So we intend to send the package on day 90, unless it falls on a weekend or holiday, when we might mail it out a day earlier, so it will get to them within the 90 days. So it should arrive between 0-89 days on their desks or within their office.

I guess the date on your GC is 07/31/2018 and not 2017, right?
          07/31/2020 - 90 days = Saturday 05/02/2020
Nov 2018 - Package sent - EB - Texas Service Center
Day 1 - Package received at the lockbox
Day 999 - Card delivered to me - Aug 2021

All my posts are based on my experience or information I read on the forums or the USCIS website. I may be wrong. Please consult a professional.

You are right. So we will either get early to post office on that Saturday or send it off on the Friday or Monday after. My hubby is aiming for May 1. Either ways it will reach them within the 90 days.
