    Hi, I've applied for I-130/I-1485 concurrent processing of my parent's GC. Last week both received a RFE asking for either a birth certificate or a secondary evidence along with a proof from letter from government authority. My relatives have tried to get NABC from local municipal departments but they have absolutely refused to issue such a letter. My parents were born in early 1950's and there was no local government at the time.

    I've already sent the properly translated high school certificate which should work as the secondary evidence but don't know what to do for for non-availability of birth certificate.

    Has anyone been in the similar situation and has some ideas for me. Should I contact an immigration attorney?

    I had similar problem with getting NABC from local authorities but ended up applying with out that documents for my parents ( both born in 1950s)....I did submit high school certificate, local ID cards and 2 affidavit from relatives for each of my parents...luckily I did not get RFE for BC/NABC but got RFE for tax documents.

    Currently the status is ready for interview. I am still concerned about the interview though. I have contacted attorney about this and she suggested showing the document which says BC/NABC is not required for people born before 1970 and also affidavits stating we have tried our best to obtain it....In our case I have got affidavit from my relative who tried to get NABC stating he has tried his best, self affidavit from my parents and copies of emails sent to local authorities.

    Since you got RFE specifically for this I suggest you talk to Attorney and they can recommend what extra documents you can provide for RFE response. You can get 30 minutes appointment for this.

      Hi Sam,

      You mentioned you had similar problem with NABC. Did you provide all the supporting documents after the RFE or you never got an RFE and had submitted the documents in the DS260 initial filing?

        Can you please let me know how were you able to resolve this issue? I am in a similar boat and have received an RFE asking for non availability of birth certificate plus 2 affidavits. The reciprocity schedule with India says that it is not required for people born before 1970.

            Can any of you please share how your situation was resolved? I'm in a similar situation and am unable to get non availability of birth certificate.

              Similar topic- unable to find how to start a new topic. My mother passed away when I was 3 years old. My father remarried and my passport has my (step)mother's name as my mother. I am in the process of obtaining my birth certificate for the purpose of green card application. My birth certificate would have my birth mother's name. What document would be best to submit to explain this discrepancy. My step-mother never formally adopted me. I do not think that my father has a formal marriage certificate (not a norm in India during that time). Any help is appreciated.
