  • New EAD using I-765 for my K1 spouse who already has a SSN

    Hello everyone:

I am hoping that someone with prior experience with their K-1 spouse applying for I-485, I-765, and I-131 (at the same time) and who applied for their SSN card within 2-4 weeks of entry into the USA and currently possesses a SSN with "Valid for work only with DHS authorization" at the top of it. Of note, we revisited the local SSA (after receiving her first SSN card that had her original name) and had her SSN card updated with her new married name. My spouse recently attended her I-485 interview and no glaring errors from the case officer (we were told by the case officer that pending no RFEs that we should see her new green card within 2 months). When filling out the form I-765, I checked on box 13a, yes, and filled out her SSN that she was issued 3 weeks after here entry in to the USA in box 13b.

My question to the community is I checked box 14 No on the I-765 form (Do you want the SSA to issue you a Social Security card?) and was wanting to find out if the SSA will issue her a new card, upon the successful I-485 and/or I-765 that removes the "Valid for work only with DHS authorization statement at the top of her current SSN card? Or will I need to revisit the local SSA armed with my wife's approved I-765 or new green card and ask the SSA for a new SSN card without the "Valid for work only with DHS authorization" statement?

A Social Security card she can get with an EAD will have the restriction text on it, so it is no different from the Social Security card she already has. They will not automatically send a Social Security card upon AOS approval. She needs to go into the SSA with her green card to get a new card.

This is my personal opinion and is not to be construed as legal advice.
