  • i-485 pending with an abusive situation

    Please share your valuable opinion! I am a French, marrying a US citizen. I am in the process of AOS ( 2 year married anniversary in Jan 2019 ). I just submitted the RFE ( US child birth certificate) and went through 2 interviews. My wife is abusing me emotionally almost everyday. We have a 3 month old son (US citizen) and living together with her old son. She threatens me to withdraw the petition and has a custody if I do not do what she asks and she curses me everyday. She is also abusive to her own son by hitting , slapping and kicking him many times and the kid was crying and screaming really much. I have proofs of evidences with lots of video about that. I was afraid of reporting the incidents for my paperwork situation. My question is that can I use the VAWA law to self petition and take a custody, also protect her own kid and my own kid for a future custody without being deported or denial for the immigration?

    Oh wow I too in the same position. My wife threatened me every weekend if I don't give her money even when she moved out. She would go out and drink and return home and without I even say a word to her she start cussing for no reason I am just trying to hang in there cause once you try to file on your own j think it would cause you a longer time than sticking it out

      Has she always been like this or after your child was born? I'm by no means justifying, but post-partum can really mess you up.

      3/23/19 - bio. notices for 4/4
      3/29/19 - biom. walk-in
      6/17/19 - EAD expedite request
      7/16/19 - card is being produced
      7/18/19 - EAD mailed
      7/19/19 - approval notices for EAD
      7/20/19 - combo cards received
      8/6/19 - ready to be sch. for an interview
      12/10/19 - interviews scheduled
      12/16/19 - interview notices for 1/14/20
      1/14/20 - interview & approval
      1/18/20 - card delivered

          Did you already have AOS interview? What was the outcome of the interviews? If you already had the interview and submitted RFE after the interview it sounds like you will be getting 10 yr green card so all you can do is waiting to receive your card then you can file police report. Can you clarify at what stage your case is?
          Marriage-based AOS - Concurrent filing.
          03/27-2018 AOS package sent to Chicago Lockbox.
          03/30- confirmation of delivery to USCIS.
          04/11- Four Email/Text notifications
          04/11- cheques cashed
          04/27- Biometrics appointment received.
          04/27-Courtesy Letter-I-693
          05/02- Biometrics walk-in
          08/01- I-765 New Card being produced
          08/03- We approved your case; I-765 & I-131
          08/08-Combo Card received

            I thought they granted me the GC on the second interview because it could not be better. It took each of us only 20 mins and the answers were almost identical. But I think they waited to see my US baby's birth certificate which they asked for RFE. Yes, I am still waiting but struggling of how abusive she is. She even threatened me to withdraw a case. By doing that, I might not be able to see my baby anymore. Will the evidence of her abusive actions ( extremely abusive to her old kid) always be valid no matter what when it will be present and to which kid she was abusive. Those evidences happened last year and at the beginning of this year.

              I need some other opinion before heading to see the Attorney. Please take into account all the facts including my pending AOS i-485. What if I report it now and have to apply under VAWA act. Is it worth it since I believe they will issue a GC in a next few months
