  • On I-485 form : Part 8 Q 61 and Q1:

    My situation: I came on B visa in 2017, apply Asylum application after 2 months and was waiting for the EAD card to start work, during waiting period of EAD. My wife applied with family, food stamp (called EBT card ; not cash assistance) and medicaid and later on stopped in 2018 after getting my professional Job. Still, my asylum application is pending and now, I have an AOS interview through Employment based!!, I select Yes on Q 61 (Have you received public assistance in the U.S. from any source? Part 8 Q61)

    Q1: Will it effect my case? as I read at USCIS memo that Asylum applicant is exempt from Public Assistance (if apply Green Card through other benefit, does courts stop USCIS for implementation inadmissibility to any alien till further notice)? does it satisfy the IO if ask that Asylum applicant is exempt and I have a memo in hand. ???

    Q2: for Part 8 Q1: Have you been a member of, involved in, or club, society, or similar group including military services in the United States or in any other world?
    I answered No; However, in my asylum application, I mention that I work on a Volunteer basis in a religious organization
    so, shall I update during interview, ??? will if effect the case and inform IO that I was misunderstood this question that it is paid or volunteer is included or not?
    {Please advise.)
