  • Can divorce my ex wife, ever after already marrying my wife in the US

    I applied for adjustment of status in August, 2019. Married my wife who is an American citizen in June, 2019. My ex wife claimed she had filed for divorce 2 years and successfully completed the divorce as she claimed. She sent me the divorce documents. But I don’t trust the documents, she might be trying to get back at me, coz if the document ends up getting verified as **** by USCIS, my application will be thrown out.

    Now, someone told me to file for divorce from my ex wife here in the US, even after I’ve married my US wife. Is it possible to do that, when I’m already married? Pls guys advise. Thanks

    This is certainly a unique question. Since you have the divorce documents that your wife sent you, I would take those documents to a lawyer, or call the country where the divorce papers was written or contact whatever authorities that's on the documents and fully verify whether the actual divorce was done and whether the documents are legal representation of the concluded marriage.. I would definitely not seek to begin a divorce proceedings in the US.

      Where did she file the divorce from? I would call that City and request for a divorce decree. You just pay to get a certified copy. Hope you best!

        When you submitted your AOS, did you not submit the divorce docs. as initial evidence?
        4/19 - RD (485, 130, 765)
        5/15 - Bio date
        8/1 - Ready to be Sched.
        8/2 - Interview scheduled
        8/7 - online update interview cancelled
        9/23 EAD exp.
        10/21 - EAD received in mail
        02/09 - interview scheduled

        130 - no updates since 4/25/19 (receipt notice)

          I am In the same situation. I am devastated. I was married in Africa. Got divorce and married my current wife in the United States 2 years ago. Applied for AOS. I just found out that my divorce to my first wife in Africa couldn’t be verified. I employed a lawyer to help me verify in Africa (I should have done this before my first AOS application). Now, I submitted a divorce decree for my first AOS application which was given to me by my ex-wife (they had no issue about my submitted divorce decree), it was denied for other reasons not related to the my divorce.
          I plan on submitting another AOS, I am not sure what to do next

          1. Should I file another AOS application with the previous decree since it wasn’t questioned?.

          2. (a) should I get a new divorce here in the United States. Remarry my wife again who is a citizen. And then file another AOS?.
          (b) if I do 2a what are my chances?

          is there anyone having similar issue? What did you do to resolve it?. Please, I will really appreciate your feedback or advise. Feel free to private message me if you are not comfortable sharing publicly. I really need your help guys.
