    Hi guys,

    It's been 55 days since I filed my I-130 and I-485 (M-1 to Green card) together. My wife is a greencard holder and she is my petitioner.

    Edit: We have checked thoroughly the copy of the I-485 that we keep and we are sure that we ticked all the right box for PR petitioner.

    Today we received a mail from USCIS asking me, for I-485 application, to provide my wife's citizenship proof. They state that it includes: Birth certificate in US or naturalization paper. But since my wife is only PR, what should we do? Has any one encounter this?

    Also, my I-20 is finishing up next year May. I have already submitted both I-130 and I-485 together, would I still be able to process my case?

    What category does it say on the I-130 receipt (it might be under "section" or "preference classification" or something like that)? Regardless, I think you would respond by truthfully stating that she is a permanent resident, not a citizen, and attaching a copy of her proof of permanent residency.

    This is my personal opinion and is not to be construed as legal advice.

      Thank you for your reply. We have checked and make sure the application copy and the receipt both show that she is a permanent resident. Regardless, I would probably send them a new letter stating the facts. I'm just a bit concern that since we send both application together, there maybe a mistake when they process both together.

        Sending them together is correct (since you filed during a month when F2A is current on USCIS AOS filing charts). If there is a mistake it's their mistake.

          Send a letter explaining, proof of permanent residency, copy of the receipts and even a copy of the forms where you correctly marked LPR. A table of contents will help too.
