  • What's my current Visa? employment question help

    Hi,
    I applied for green card based on marriage in Sep 2019, and I am still waiting for comb card.
    I am looking for jobs, however, companies always ask me "whats your visa type?"
    Companies always take 2-3 months for interview, I told them I will receive my EAD card in next two months, and green card in next 4 months. Looks like they dont like my answer.

    Can someone help tell me what correct answer I should say in future interviews?
    San Jose F1 AOS with UC 4 forms
    9/24 2019: Sent 4 forms to Chicago
    9/27 2019: PD
    11/1/2019 : Fingerprints done
    12/13/2019:Case is ready to be scheduled for an interview
    1/21/2020: Interview was scheduled
    2/25/2020 12pm: we interviewed in San Jose.
    2/25/2020 5:00pm: I-485 new card is being produced.

    Some company don't ask "what type of visa " during interview. I for one did not ask for that, the HR called me if i'm still interested for the job I applied for the interview. She book my interview and during the interview did not even ask me what my current status. its after I was selected and offered the job that HR start to ask my AED but at that time I already expedited my AED because I have a job offer. I delayed the job offered signing for a week so that I have a window for processing my expedited AED. After two weeks I got my AED card and SSN card in time for the submission to HR. Now , I'm waiting for my past company and school to done with background check before I can start my work. Next week is my I-485 interview.
    10/10/19- Case is ready to be scheduled for interview...
    10/29/19 - I-485 Interview notice received.

    12/05/19 - Interview day @ 10:45 am

    03/13/2023 - Interview for N400
    03/13/2023 - Pass interview same day sworn in as US citizen.
    03/18/2023 - Applied for US passport. Saturday Passport caravan.

      Unless you have proof that your Green card or EAD card is approved, you cannot simply start working. That's why the companies aren't giving you feedback. Without work authorization, Permanent residency, or an EAD card, you are not allowed to work. Right now, you have just had your interview. The GC isn't necessarily approved yet, it's still pending adjudication. Until you get proof that your GC is approved, you will have to wait.

        Xingmin: you current status is pending AOS.look at the actual processing times on uscis webpage.hoping to get combo card within the next 2 months is,bold,to be honest.look at forum july'19 filers for example, I applied july,did biometrics September 4th and still no EAD.A lot of July filers are still waiting.don't want to discourage you,but be realistic, and patient. Good luck!

          Highly unlikely that you will have your green card in 4 months, based on current experiences. National average is 12 months.
          3/3/19 - filed
          3/6/19 - received by USCIS
          3/12/19 - texts received, checks cashed
          3/16/19 - receipt notices received
          3/23/19 - bio. notices for 4/4
          3/29/19 - biom. walk-in
          6/17/19 - EAD expedite request
          7/16/19 - card is being produced
          7/18/19 - EAD mailed
          7/19/19 - approval notices for EAD
          7/20/19 - combo cards received
          8/6/19 - ready to be sch. for an interview
          12/10/19 - interviews scheduled
          12/16/19 - interview notices for 1/14/20
          1/14/20 - interview & approval
          1/18/20 - card delivered

            Maybe they read my resume and found im still in school student, then ask my visa type. Or maybe my name is too foreigner.

              Actually, I havent done immigration interview yet. Big companies usually take 2-3 month for their interview process, so its the reason I am applying now.

                Yeah, two months may be so optimism. lol. But I see some August fillers already received comb card.May I ask, is national benefit center processing my comb card or the local immigration center does?

                  Really? Marriage with US citizen still needs to wait 12 months?

                    Xingmin,you can see on your receipt, NOA if your case is being processed at the national benefit center, your number should start with MSC.and,yes,right now average processing times for marriage based AOS is between 14,5-17,5 months

                      Its weird. I saw most of June fillers received green card

                        It depends on,where you filed and what your local field office is,that's processing your case.they are backlocked for example at national benefit center. Also,the Visa category. And,if someone gets a Request for evidence. That delays a case,too.

                          You might want to omit your "student" at present on your CV so that they will not ask you for your status of visa. Name does not matter as long as your able to do and qualified for the job they are looking. The question is IF your going to quit school after you got a job or maybe be able to reschedule your school time after work. The important thing to do is to be able to secure an interview and get a job offer and then apply for expedition of your I-765 so you can start work while your waiting for your I-485 interview. Two birds in one stone. It is doable as I am currently doing it right now. I am waiting for my job background check clearance for 3 weeks now since most of my work and educational docs were done overseas , additionally, my interview is next month Dec. 05 ,2019.

                              Is there a particular reason you’re looking for jobs now? If there’s risk of severe financial hardship, you could always request expedited processing for your EAD. Though, of course, it’s never guaranteed.

                              I suspect companies aren’t responding because they know how unpredictable (read: unreliable) the USCIS can be with their timelines. I understand that from their point of view it’s pointless to use HR resources to screen applicants who can’t be reliably hired given their tenuous/pending employment status.

                              On another note, if you’re still a student, your status remains F-1 (or whichever) as long as you maintain courseload that qualifies as full-time. Once you’ve filed your AOS, you could technically drop the courseload, lose the F-1 status, and still legally remain in the US due to your pending application. However, bear in mind that should your AOS be denied, you will be out of status and cannot fall back into the F-1 once you lose it.
