Whoever can help,

My husband and I are in the process of filing the I-130 Petition for Alien Resident as well as the I-767 Authorization for employment. My question is do you have to file the I-485 if you are filing the I-130. Initially we sent in the I-485 with all the other papers and they were sent back. My husband and I were under the impression that they sent it back because we were already filing the I-130. However, now they said they need for evidence (that we filed the I-485) in order for the I-767 to go through,(which is the Authorization for Employment. Has anyone had this issue, and if so do we need to file the I-485 if we have filed the I-130??

Basically, if you are sending I-130, and your spouse needing AOS is with you in the USA, then you can apply submit I-130, I-485 and I-765 (EAD) concurrently, however, I don't believe you can send in I-130 and I-765 alone, since I-765 and I-485 kind of go hand in hand, if one wants AOS (I-485) then they are able to apply for I-765 (EAD).

Not a lawyer, but I hope this helps you.... I also believe the total amount would $1010 for AOS/EAD and $355 for I-130.

Research a little bit more, to get your own understanding, but this is what I did.. before I sent in my applications, hope this helps...
