  • No EAD/ nothing after 149 days

Hi. I’m running out of ideas and patience. Filed July 15 and biometrics completed on August 6.
“Ready to schedule interview” November 15.

Its almost 148-149 days since filing but no EAD/AP yet. No interview date yet. I see here others who have filed in July / August have atleast received their EAD

i need to make travel plans next year (not urgent so cannot expedite) but basically I cannot do anything. It’s like holding me hostage.

Ive called multiple times only to be told “within processing time” but I have seen the processing times increase in front of my eyes

not sure what else I can do.

It seems every field office is a whole different story.
I’m sorry you’re going through that, the only thing I can tell you is to be strong!

and if it’s any consolation, my status changed to interview scheduled a month after it had changed to ready to schedule your interview!

If I were you, while waiting for the your I-485 interview, you might want to apply for a job and if you got a job offer, then you can expedite your AED and Advance parole card at the same time.
Only if you need a job or something to work on while waiting for uncertainty.
          Just my 2 cent.

Thank you. I have a valid H-1B until 2022 and currently working so unfortunately or fortunately that’s not a reason !
my annoyance was more related to not being able to make any sort of travel plans or anything until this sorts itself out

Do you have a valid H-1B that expires until 2022? Then you can travel without any problems and come back. The AP is only needed for most other visa categories.

Your application will not be abandoned, not like almost all other visa categories that need AP to travel abroad.

Your application will not be abandoned, like almost all other visa types.
                FYI

H-1B holders traveling outside the United States with pending AOS If the applicant has a valid H-1B visa and possesses a pending AOS application, it is not mandated to obtain an Advance Parole to reenter the United States. Actually, if a H-1B visa holder reenters the United States with the Advance Parole, his/her H-1B status will be terminated. The foreign national would then be labeled as a “parolee.” A “parolee” is able to continue working under the H-1B employer, however, he/she will not be able to obtain valid H-1B status until the employer has filed for extension and had the application approved on his/her behalf. Though, this condition is only valid if “the alien’s H-1B or L-1 employment authorization would not have expired had the alien not left and returned under advance parole.” To avoid complications and maintain H-1B status, the visa holder must reenter with the H-1B visa and meet the following requirements:

Hold a valid H-1B entry visa on his/her passport
Maintain the same H-1B sponsoring employer (he/she cannot change employers)
If the foreign national under H-1B status has reentered under AP and the AOS (Form I-485) has been denied, the foreign national is considered out of status.

Wow I didn’t know this! I’m assuming from uscis website ?
i always thought my 485 will be abandoned if I travel while it’s pending

and yes my H-1B is valid until June 2022 and I’m with the same employer

                  thank you !

If you have a lawyer, you should ask him/her about traveling with your H1B visa.

I received my combo card after 207 days of waiting. It’s a long wait unfortunately, gone are those days when you can get it after 2-4 months.

I was waiting for 6 months to get my EAD and 9 months for the renewal . Being patient is the only thing I could advise you, unless you have a very strong proof of financial difficulties or hardships
