  • RFE and no response from USCIS over 60 days

    Hi;

    I received the RFE letter for my newborn's birth certificate in Sep and submitted on Oct 7. I called USCIS many times including 2 times after 60 days. They created a request of inquiry for me but they said it will take at least 15 days to 30 days to respond. The deadline in the RFE is Dec, 25. What if they respond to me after a deadline and still not receive or locate my RFE document. I have a usps tracking number for the mailling.

    Thanks

    I don't know what to tell you. In total, I have answered 5 RFE (different cases) and in all cases, the online system updated to "Response To USCIS Request For Evidence Was Received", most after 2 weeks but 1 after 4 weeks. I sent the responses by FedEx.

    If I were in your shoes, I'll send a copy of the RFE letter, another birth certificate and a letter explaining that you already submitted the response on date X, via USPS with tracking number X and signed/received on date Y by X person, saying that you haven't received a confirmation and you don't know if the previous package was lost. Just an idea.
