  • passport expiring in 6 weeks,please help

    MY indian passport is expiring in a span of 6 weeks.I was on H1B,i resigned my company 3 weeks back.I married to a USA citizen.This week i am expecting to apply for change of status/green card.For issuance of new passport we need EAD/GREEN CARD/WORK AUTHORIZATION or valid visa.I think my employer applied for my H1B cancellation.Please let me know whether i can renew my passport showing marriage certificate.pls help urgent.I have driving licence from new jersey,but now i am in california.Can i renew my passport using my marriage certificate issued by the state,or by using utility bills or car insurance or lease agreement?please help.

    Simple!

    You must maintain a valid passport from your country of origin all the time, until you receive a favorable decision from USCIS. Even you get a GC; you still need a valid passport to travel abroad. You can call the embassy and ask them what they require, since you don't have an EAD/GC yet. I am sure if you can send them a notarized copy of your State ID or driver license, it will work just fine.

      apply asap with your current visa

      Is it the policy of the Indian Embassy to require the documents you listed? If so, it seems like your only option is to present one of those.

      If you only resigned three weeks ago, chances are no action has been taken on the revocation of your H1B at the governmental level. Regardless, I would think that there would be some leeway between revocation and expiration in order to give the visa holder time to tie up loose ends and make travel plans, so your H1B will probably be valid for a few more weeks. Get your passport ASAP before it is no longer valid.

      Or you might be able to apply for AOS and use the I767 to apply for a new passport. You might have to file a supplemental I-485 form. It will cost additional fees, but if it works it will be worth it.

        Thankyou very much for your help.I have some questions about driving licence.I have licence from new jersey,but i live in california now.Is it ok if i show some utility bills or lease agreement or car insurance or marriage certificate issued by the state to renew my passport?please help.
