  • Interview problems

    My wife had her interview for AOS in july. Interviewer asked questions while looking thru our I485 file. As the meeting came to an end, he said we should get a decision in the mail in 3 or 4 weeks.
    But for the last 5 months we check our status on line. It always said interview complete, but our file needed more inspection.
    Then we get a letter of denia in the mail last friday. It said since we never responded to their request for further evidence, our application was considered abandoned, it was automatic denial.
    We never received any requests for further evidence. We never got anything in the mail after the interview, except her EAD card several weeks after interview.
    I tried calling USCIS and the guy at Uscis said he had nothing to tell me, and everything I needed to know was in the denial letter.
    Tomorrow we are going to call the 800 number again. Hoping someone will answer our questions. The letter said we could file a I-290. If we we dont respond in 30 days, she had to leave the country.
    we've been married 2 1/2 yrs!!!! This is a nightmare

    You should immediately make an appointment for infopass and see what they say there. This is unbelievable. Possibly get a legal expert involved because of the denial

      I'm sorry this happened to you. Were you able to check the status in both sites (egov and myaccount.uscis)?

      I can't believe that they can't send a text/email and have the document (PDF) online for people to review in case the mail gets lost. Who thinks that people will go to an interview and then just don't send requested documents. Unbelievable.

          Submit a message to USCIS Ombudsman meanwhile.
          3/3/19 - filed
          3/6/19 - received by USCIS
          3/12/19 - texts received, checks cashed
          3/16/19 - receipt notices received
          3/23/19 - bio. notices for 4/4
          3/29/19 - biom. walk-in
          6/17/19 - EAD expedite request
          7/16/19 - card is being produced
          7/18/19 - EAD mailed
          7/19/19 - approval notices for EAD
          7/20/19 - combo cards received
          8/6/19 - ready to be sch. for an interview
          12/10/19 - interviews scheduled
          12/16/19 - interview notices for 1/14/20
          1/14/20 - interview & approval
          1/18/20 - card delivered

            This is the time to get a lawyer..... Get a lawyer and all will be well. Seems like mistake is from USCIS and not you. The main issue here will be, "where the notices for RFE sent and you guys just never received them, sent to wrong address by USCIS or Never sent by them at all? " Those are the only 3 possibilities. Get a lawyer Today! I'm really sorry you guys are going thro this, this is one of the most stressful situations that has a Direct Impact in your life and loved ones but you have absolutely no power over.             11/29/19 Card ran by USCIS for $1225
            12/13/19 Notice for Biomterics appt.
            12/23/19 Biometrics
            1/31/2020 Yellow RFIE in mail(missing Birth certificate)
            2/5/2020 RFIE received at USCIS
            2/14/20 Received I 693 courtesy letter
            2/14/20 ready to be scheduled intervw
            08/31/20 EAD /SSC
            09/03/21 Notice for biometrics appointment I 130 USC
            10/04/21 Case actively being reviewed

              Your case was denied for abandonment. I would recommend you file the I-290B, pay the fee and state that you never received the notice and you never moved. In most cases, they will just reopen your case and resend the RFE. However, if you moved and you failed to update your address, they would more than likely deny your case as it was your fault and not just an error.

                Am sorry you are going through this but it happens from time to time. Basically you have 2 options:
                1. File a motion to reopen on grounds you did not recieve the RFE,
                2. Refile everything all over again.

                In my personal experience, my i-130 was approved on spot but my i-485 was held for review. After close to 2 and a half years, they sent me an RFE to redo my medical as it had expired. The weird thing was the my name and address were wrong on the RFE but somehow USPS(bravo) was able to deliver it to me in a different city and state. But for the usps being able to deliver the RFE to me I probably would have had the same problem as there were no updates about it in my online status.

                  I agree with mindrd. That's the only option in this case. Otherwise, you have to start over (which is an option in marriage base application). Infopass is no longer an option since USCIS closed this avenue. You should hurry up with filing I-290B because of the tight filing frame, within 30-33 days they count weekends and holidays.

                  I was in kind of similar situation, however I didn't get to the actual interview. I moved to a different state, 700 miles away. I asked them to change my address and reschedule the interview (at that point I had an interview notice). My EAD arrived to the new address, and later calls to USCIS, talking to level 2 confirmed my case was transferred. Months later I got denial notices for both I130 and I485 from initial office in a different state saying we didn't show up for the interview, and thus our case is denied due to abandonment. The letter stated the interview date we've never known about or got any notices (the original notice I had had a different date).
                  We've hired a lawyer and filed I290B.
