  • RFE 1040 Tax form but I wasn't required to file

    When I (sponsor) mailed in my package mid October, I made a note in the additional information section of my I-864 that I wasn't required to file taxes because I've been a full time student these recent years. My wife now received an RFE for the initial I-864 sponsors 1040. Do I just send a letter stating once again that I wasn't required to file taxes for the most recent tax year?

    I also included an I-864 from a joint sponsor in the original package because I know I wouldn't meet the income requirement. Would they still send this RFE if they have my joint sponsor's I-864? I'm sure they must have it since everything was packaged together.

    They work with lots and lots of files and paper every day. I think they must lose documents all the time. Some part of your package may have ended up in someone else's file. Just human error. But it can cost you big time. So to be safe, I would send a letter in response that explained that you were not required to file again and I would send them all the I864 forms and all the supporting documents again. I'd rather they have it all twice in the right file than not in my file at all. But that's just my personal opinion based on my experience with USCIS.

      Note that whether you are a student or not has nothing to do with whether you are required to file. You are required to file if your (worldwide) income that year is above a certain threshold, which is in that year's Form 1040 instructions in the section "Do You Have To File?". You need to explain that your income that year was below the relevant threshold.
